    • Will and Probate of Daniel Hayes is found in File #30-5 Surrogate's Court, Clinton County, New York (transcribed by Norma Meier). Abstract of will was not made since it contained no information not found in probate. A codicil dated 23 October 1869 stated a daughter Emaline, listed as Emaline Philips in the will, is now married to a Dragon/Dragoon. Executors of will were Jane Ann Hayes, widow; and Nathan A. Vaughan, J.P.

      Final settlement was made 25 June 1873 when Vaughn deposes that citations were sent to out of state heirs: J. Wesley Hayes of Ellington, Hancock County, Iowa; Gilbert N. Allen of Byron, Ogle County, Illinois; William N. Hayes of Big Springs, Wisconsin (an earlier paper gave his address as Adonur County, Wisconsin.) Vaughn delivered on the same date citations to Louisa M. Storrs of Plattsburgg; on 27 June to Reuben W. Hayes of Schuyler Falls, New York; on 8 July to Seneca Allen of Plattsburgh, guardian of Westley Allen; 15 August to Emaline Dragon, formerly Emaline Philips of Saranac or Blackbrook not knowing where line between towns is; and on 16 August to Lucius Hayes of Plattsburgh (an earlier paper of 1870 stated he lived at Jessup, Buchanan County, Iowa.)

      Legacies paid were $5 each to Reuben W. Hayes and Wesley Hayes, $50 to heirs of Cornelia Allen; $100 to W. N. Hayes; $600 to Lucius Hayes; $200 to Emeline Philips; and $1,748.46 to Jane A. Hayes. Jesse Gray was appointed by Surrogate of Clinton County as special guardian for Cyrus W. Allen, minor heir of Daniel Hayes. Hornick & Pierce, Plattsburgh, New York received payment of $37.60 for black walnut coffin, plate and engraving, merino shawl, collar and tie. A claim against estate was made by Smith Fordham for care given by he and his wife to Daniel Hayes during his last sickness; also for filing a saw, fixing a lock for a total of $12.50. Claim was made by Elisha Hayes for shoeing a horse, for going after Emeline in Ellenburgh, for eight and a half pounds of butter and "my wifes help taking care of Daniel Hayes in his last sickness, 4 days and 3 nights in all," for a total of $13.18.

      "Set off to Widow" were the following: "4 Beds and Bedding and Bedsteads, Two stoves kept for family use with their pipes also the Cooking utensels belonging there, one old Brass kettle, one pair of shovel and tongues, 12 flat irons, 2 set of Common Chairs and 4 old Rockers, one Beaureau, 2 Cherry Tables and 2 Common pine tables and covers for 3 tables, 2 light stands & 2 wash Stands and one old Settee, 1 large Mirrow and 4 Small glasses, 1 clock, a Small Lot of Crockery for Table use and some 12 tin pans for Milk, 4 pails for water and milk also 2 Butter Jars and one Cream jar and 3 small fruit Jars, 1 wash Tub, 1 wringer for clothes and its fixtures, 2 wooden Churns, some 5 Jugs for use of the house, 4 wooden Bowles for Butter and use of the house, 1 spinning wheel, 1 Reel & Swiffs, 1 Cloths Bars, The family Bible and a few other Books belonging to the family Library, 1 Parlor Carpet & 1 Dining room Carpet (Rag), one stair carpet, some Rods to fix it down, Common Curtains for 7 windows, the widows own Clothes and the Clothing of the family, one Red team and Ten Sheep and 7 fleeces of wool which came off from 7 of the Sheep and a few rolls from the balance of the sheep, one hog and the Balance of Pork on hand from one hog, Six old Silver Teaspoons and 5 old plated Teaspoons and 3 Plated Table Spoons."

      George was an orphan by age 10 and living with a Mr. Theu in Saranac, Clinton County, New York. George was an heir in his Aunt Mary's will.

      Daniel and wife Mary are buried in West Plattsburgh Union Cemetery, Morrisonville, New York. Daniel's gravestone reads, "DANIEL HAYES DIED Jan. 9, 1870 in his 78th year." Her gravestone reads, "MARY WIFE OF DANIEL HAYES DIED SEPT. 10, 1862, AE. 71 Y'RS." They are buried on Lot 112, along with Cornelia Hayes Allen and Seneca Allen. The large Hayes plot includes adjoining lots 97, 111 and 112.
